Terms and Conditions – WeChat Policy Binding Service

Tahoe Life Insurance Company Limited (Incorporated in Bermuda with limited liability) (“Tahoe Life”) shall provide, subject to these terms and conditions herein (“Conditions”), WeChat policy binding service to enable policyholders to view policy basic details (the “Service”).

By registering the Service or using password to login the policy enquiry page, you shall be deemed to have accepted and be bound by the Conditions for use of the Service. Please read the Conditions carefully. The Conditions may be revised by Tahoe Life at any time by updating this page from time to time without further notice. You should therefore periodically visit this page to review the current terms and conditions. 

1. Scope of Service
   1. Tahoe Life has the full right to determine and vary from time to time the scope, type and servicing hours of the Service to be made available, including but not limited to, a) expanding, modifying or reducing the Service at any time; b) imposing and varying any restrictions on the use of the Service; and c) suspension or termination of your access to all or any of the Service without giving prior notice or reason. You may terminate the use of the Service at any time.
   2. You shall assume full responsibility and risk each time you view or print any portion of the information available to you in the Service or each time you use the Service. The password you may use to access to the Service will be recognised as your electronic signature and will be legally binding. 
2. Use of Service
   1. To access the Service for the first time, you are required to register online and indicate your acceptance of all the terms and conditions governing the use of the Service and to provide the information as Tahoe Life may reasonably specify for identifying you.
   2. By registering to use the Service, you warrant that all information provided by you to Tahoe Life in relation to the Service (including your personal information and other contact details) is at all times true, complete and up-to-date.
   3. The Service is for your sole and exclusive use. You shall not allow anyone other than yourself to access or use the Service.
   4. Any exchange rate, interest rate, price and information quoted on the Service are for reference only and are not binding. 
3. Personal Information, Identifiers and Instructions
   1. To register the Service, you shall follow the relevant guidance in filling personal information and designating personal identifiers that Tahoe Life requires for identifying you for the purpose of the Service.
   2. You shall exercise reasonable care and diligence in keeping all the personal identifiers safe and secure. At no time and under no circumstances shall you disclose any personal identifier to any other person.
   3. You shall be fully responsible for any accidental or unauthorised disclosure of any personal identifier to any other person and shall bear the risks of any personal identifier being used by unauthorised persons or for unauthorised purposes.
   4. Should there be any notice or suspicion of any loss of personal identifiers or any unauthorised use of the Service, you shall notify Tahoe Life as soon as practicable and you shall remain responsible for any and all use of the Service by unauthorised persons or for unauthorised purposes.
   5. You are required to quote one or more of the personal identifiers requested by Tahoe Life from time to time in order to login to the Service.
   6. Any instruction given in connection with the Service by quoting the personal identifiers, once given, may not be rescinded or withdrawn without the consent of Tahoe Life. All such instructions given, as understood and acted on by Tahoe Life in good faith, shall be irrevocable and legally binding on you whether given by you or by any other person purporting to be you. Tahoe Life shall be under no duty to verify the identity or authority of the person giving any such instruction or the authenticity of such instruction apart from verifying the personal identifiers submitted.
   7. Tahoe Life will only act on an instruction insofar as it is in our opinion practicable, lawfully and reasonable to do so and in accordance with applicable laws, Tahoe Life’s regular business practices and procedures.
   8. Where Tahoe Life knows or suspects a breach of security measures or other suspicious circumstances in respect of or in connection with the operation of the Service, Tahoe Life may, in its absolute discretion and without any liability, refuse to act on or delay acting on the instruction and in that event, Tahoe Life will, to the extent possible, inform you as soon as practicable. 
4. Information and Materials
   1. All information and materials contained in the Service, whether provided by Tahoe Life or any other information provider, shall: (a) be provided for general information and reference only; (b) not constitute an offer or solicitation to buy or sell any products or services of Tahoe Life or to provide professional advice to you. All products and services are subject to the terms and conditions of any applicable agreements.Information and materials provided on the Service is believed to be reliable when posted but may no longer be true, complete or current when viewed by you. All contents in the Service are subject to modification from time to time without notice.
5. Copyright and Intellectual Property Rights
   1. All the contents, information and trademarks on the Service are protected by copyright or other intellectual property rights. You are not allowed to reproduce (in whole or in part), modify, decompile, disassemble or transmit or use such contents, information and trademarks in any other way for any commercial purpose without prior written consent from Tahoe Life or the parties owning them. 
6. Disclaimer
   1. Whilst every care has been taken in preparing the information and materials in the Service, (1) the information and materials on the Service are provided "as is" and without warranties of any kind either expressed or implied and Tahoe Life disclaims all warranties, expressed or implied; (2) Tahoe Life does not warrant that the Service or the functions in connection with the Service will be uninterrupted or error-free; and (3) Tahoe Life does not warrant or make any representations regarding the use or the results of the use of the information/materials on the Service in terms of their correctness, accuracy, reliability, or otherwise.
   2. Under all circumstances, Tahoe Life, its related company, directors, employees and agents shall neither be liable nor bear any responsibility for any direct, indirect, special, incidental, or consequential losses or damages, arising from the use or inability to use of the same by any party, unless such losses or damages are solely caused by willful default of Tahoe Life, its employees or agents.
   3. The Service may contain hyperlinks to third party websites for reference only. Tahoe Life shall not be liable for any losses or damages arising directly or indirectly (including consequential loss) for the contents available on such websites. The inclusion of hyperlinks to third part websites by Tahoe Life does not imply Tahoe Life has endorsed any materials on such websites.
   4. You agree that due to unpredictable traffic congestion, openness and public nature of the internet and other reasons, the internet may not be a reliable medium of communication and that such unreliability is beyond the control of Tahoe Life. Therefore, you agree that, unless it is solely caused by Tahoe Life’s willful default, Tahoe Life shall not be liable for any damages, losses and expenses as a result of any delay in transmission, incorrect data transmission, misunderstanding and errors in any communication between Tahoe Life and you, transmission blackouts, interruptions and so on.
   5. You acknowledge and confirm that wireless fidelity (WIFI), internet or other data transmission medium is not absolutely secured to ensure privacy is protected, and up till now, complete security and confidentiality over the use of the said medium is not possible, and is beyond the control of Tahoe Life. You acknowledge that your use of the Service (including information that you may transmit via the Service) may be subject to access by, or disclosure to, other persons. Without limiting any other disclaimers herein, Tahoe Life shall not be responsible or liable for any losses or damages that you and any other person may suffer in connection with any such breach of confidentiality or security.
7. Privacy Policy
   • The personal information collected from you shall be used in accordance with Tahoe Life’s Privacy Policy Statement which is available from the website (https://www.tahoelife.com.hk/tl/en/privacy_policy/) and the Personal Data (Privacy) Ordinance (Chapter 486).
8. Jurisdictional Issues
   • Tahoe Life makes no representation that the information and materials contained herein is appropriate or available for use in any locations or jurisdictions.
9. Governing Law and Jurisdiction
   • This Conditions and your use of the Service will be governed by the laws of HKSAR and the parties agree to submit to the exclusive jurisdiction of courts of HKSAR.
10. Inconsistency
    • In the event of any inconsistency between the English and the Chinese versions of the Conditions, the English version shall prevail.
